  • Child Custody: A Brief Overview By Bryan Salamone, Esq.
    November, 2011
Child custody represents the legal right of a parent or guardian to provide guardianship to a child under the age of 18. In many countries, this is also referred to as a child’s “contact” with a parent or guardian. In most child custody cases, the issue of residency, or which parent the child lives with, remains the most hotly debated issue. Upon the commencement of divorce proceedings, parents may come to court already in agreement about custody of their child, but either parent may argue his or her case for full custody or partial custody or visitation rights. After having heard their testimony, as well as that of child psychologists who have interviewed the child, it is the responsibility of the presiding judge to then determine what living and visitation situation would be in the best interest of the child. The varying types of custody currently include alternating, bird’s nest, joint, sole, split, and third-party custody.

Even though parents may not have previously agreed on joint custody, they may still carry out custody proceedings in a nonviolent, mediated atmosphere. However, when custody hearings make their way to antagonistic litigation, the battle between parents or guardians often becomes heated and may involve accusations of abuse, parental alienation, manipulation, or sabotage. In these cases, it remains of the utmost importance that knowledgeable and experienced legal professionals handle the proceedings and that children be shielded from harsh, vituperative language.
