  • Counterfeiting in the Modern Age, Joseph Metallo
    August, 2011
    By Joe Metallo

As technology only continues to contribute to the increased capabilities of piracy and counterfeiting operations, individuals and companies require specialized strategies to hinder such efforts and hopefully eradicate them all together. Defined as the illegal use or production of an item or property that retains a trademark or patent, counterfeiting continues to be taken very seriously within the United States and around the world. With global trade as yet another obstacle to hampering counterfeiting attempts, penalties and laws have greatly increased in recent years; however, they remain difficult to monitor and enforce.

The Anti-Counterfeiting Trade Act serves as a proposed solution, working to establish international rights on the part of intellectual property owners. Retaining its own governance system similar to the United Nations or the World Trade Organization, the Anti-Counterfeiting Trade Act proposes to monitor generic medicines, Internet copyright infringement, and counterfeit goods, among other items. While specifics of the organization’s scope and power remain under negotiation, many countries throughout the world support such a platform, including Japan, the United States, Australia, New Zealand, Switzerland, and the European Union.
