    The Domestic Relations Court hears cases in the following areas: divorce, annulment, dissolution of marriage, legal separation, and civil domestic violence protection orders. When one party does not abide by a court order, such as those enforcing health insurance and child support payments, individuals have three alternatives: obtaining an attorney, requesting Montgomery County Support Enforcement Agency assistance, or filing a motion to show cause on their own. The latter option is called pro se, and it is not generally recommended, as individuals representing themselves are held to the same level of legal knowledge as qualified lawyers.

    Procedures followed through the Domestic Relations Court involve a motion to show cause, followed by a hearing. All motions refer to the violated court order and are accompanied by an affidavit stating when and how the violation occurred. The hearing offers a chance for the plaintiff to present evidence supporting the motion, in compliance with the Ohio Rules of Evidence. Temporary orders generally occur within a week of the hearing, with full Magistrate’s Decisions filed with the Clerk of Courts within 30 days.

    People who do not agree with the judge’s decision have a 30-day window in which to submit a written notice of appeal with the Second District Court of Appeals. In these cases, a transcript of the hearing is required to support one’s claims.
