When individuals seek medical advice, they expect the utmost care and attention, afforded by the physician’s experience and extensive training. As humans, however, even physicians err. When medical care providers become negligent and that lack of attention results in harm to a patient, the patient may seek damages through medical malpractice tort. Malpractice may arise from an inaccurate diagnosis, mismanagement of care, or incorrect treatment. In addition, medical malpractice suits may also target hospitals that do not offer adequate training, possess below-average sanitation, or do not properly store medications and other equipment. Those who wish to pursue a malpractice suit should discuss their case with a qualified attorney as soon as possible to learn about the steps involved and the expectations of the plaintiff.
Today, most states have passed laws that limit malpractice suits and protect the healthcare industry. For example, many states have instituted caps that dictate the maximum amount of damages awarded in a particular case. In addition, a majority of states place time limits on filing claims in all but the most extenuating circumstances. Plaintiffs must commonly file a certificate of merit before seeking malpractice action, which requires that another physician look at the case and agree that the health care provider in question did not follow standard acceptable practices.
Individuals must understand the limits of medical malpractice before they decide to pursue a claim. Medical procedures have no guarantee of success and thus an unsuccessful treatment or unexpected outcome does not necessarily constitute malpractice.
